1. General Provisions
These Terms and Conditions (hereinafter — "Terms") govern the relationship between the Site Administration of www.daria-de-vital.com and any user who visits or uses this resource. Use of the site implies unconditional acceptance of these Terms. If a user does not agree with any of the provisions, they must immediately cease using the site.

The Administration provides the User with access to the artist's website, including images, texts, videos, and other materials. The User agrees to comply with the rules for using the site as specified in these Terms.

5. User Rights
The User has the right to:
• Freely view the artist's works, textual information, biography, news, and announcements.
• Use the information on the site for personal, non-commercial purposes.
• Contact the artist via contact forms and provided details for the purchase of works, ordering reproductions, or participating in exhibitions and presentations.

6. User Obligations
The User agrees to:
• Not use the site materials for commercial purposes without the written consent of the Administration.
• Not copy, reproduce, or distribute images of the artist's works on the Internet, marketplaces, social networks, or in printed products without specific authorization and attribution to the author.
• Not disrupt the functionality of the site (e.g., by using bots, automation scripts, or DDoS attacks).

7. Rights and Obligations of the Administration
The Administration has the right to:
• Modify these Terms unilaterally by publishing the updated text on the site.
• Restrict access to part or all of the content.
• Protect the copyright and intellectual property of the artist, including through legal action in case of unauthorized use of materials.
The Administration undertakes to maintain the functionality of the site within reasonable limits and to ensure the protection of users' personal data in accordance with applicable EU laws.

8. Shipping and Delivery
Responsibility for any damage occurring during transport rests with the carrier (shipping company). Upon delivery, the User is required to check the integrity of the package in the presence of the courier. In case of visible damage to the packaging or the artwork, the User must sign the delivery receipt "subject to inspection" (con riserva di controllo) specifying the damage, or refuse delivery. Failure to immediately contest the damage to the courier may prejudice the possibility of obtaining compensation from the carrier.

9. Right of Withdrawal and Returns
In accordance with the Consumer Code, the User has the right to withdraw from the purchase within 14 days of receiving the artwork. However, pursuant to art. 59, paragraph 1, letter c) of Legislative Decree 206/2005, the right of withdrawal is excluded for the supply of goods made to measure or clearly personalized (e.g., commissioned portraits, works created according to the User's specific requests, or with personalized dedications).
In such cases, the sale is considered final, and no refund or return can be requested.

10. Copyright and Responsibility
All artworks, texts, photographs, and other materials on the site are protected by copyright and belong to Daria Ozerova or third-party rights holders. Unauthorized use (e.g., reposting without authorization, resale of reproductions, or use in advertising) constitutes a violation and may lead to legal proceedings.
The purchase of an original (physical) work of art does not involve the transfer of copyright to the User. All rights of reproduction, publication, and commercial exploitation remain the exclusive property of the Artist (Daria Ozerova), unless otherwise agreed in writing. The purchaser is prohibited from any form of reproduction or commercial use of the work.

11. Applicable Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of Italy. In the event of a dispute, an amicable resolution will be sought. If an agreement is not reached:
• For users acting as consumers within the European Union, disputes may be resolved before the courts of the User's place of residence.
• In all other cases, disputes shall be subject to the jurisdiction of the Italian courts. "In accordance with Art. 14 of Regulation (EU) No. 524/2013, the user is informed that it is possible to use the ODR (Online Dispute Resolution) platform for the resolution of disputes, accessible at: https://ec.europa.eu/consumers/odr/."

12. Termination
The User may stop using the site at any time simply by ceasing to access it. Continued use of the site following any changes to the Terms constitutes acceptance of the new conditions.
